Cover Version Tanpa Izin Pada Platform Digital Legal Protection for Music and Song Creators Against Unauthorized Cover Versions on Digital Platforms

Abstract


The development of digital platforms has provided greater convenience for the public to create and distribute musical works, including through the production of cover versions. However, the use of musical works without the creator's permission may raise legal issues concerning copyright protection and legal liability. This study aims to analyze the legal protection afforded to song creators against unauthorized cover versions on digital platforms and the legal liability of parties who upload musical works without permission. This study employs normative legal research using a statutory approach and a conceptual approach. Legal materials are analyzed qualitatively by referring to Law Number 28 of 2014 concerning Copyright and other relevant regulations. The results show that song creators are protected through moral and economic rights. Therefore, the use of musical works in the form of cover versions, particularly for commercial purposes, must take into account permission from the creator or copyright holder. Parties who upload musical works without permission may be held legally liable if their actions fulfill the elements of copyright infringement, through either civil or criminal mechanisms. Thus, the use of musical works on digital platforms must continue to respect the exclusive rights of creators and comply with applicable legal provisions.
