An Analysis of a Husband’s Obligations Toward His Wife in Cases of Nusyuz from the Perspective of Islamic Law

Abstract

This study discusses the obligations of a husband toward his wife when the wife is in a state of nusyuz (disobedience) from the perspective of Islamic law. Nusyuz refers to a wife's refusal to fulfil her marital obligations, such as rejecting her husband's requests without valid reasons, leaving the home without permission, or showing disobedient behavior. Such actions can disrupt the harmony and integrity of family life. This research aims to describe the criteria of nusyuz in Islamic law and analyze the husband's responsibilities in addressing it. The study uses a library research method with a descriptive-analytical and normative-juridical approach. Data were collected from the Qur'an, Hadith, classical Islamic legal texts, and legal instruments like the Compilation of Islamic Law. The findings show that Islamic teachings provide a three-step approach in handling nusyuz: advising the wife, separating beds, and if necessary, applying a non-harmful form of discipline. According to Indonesian positive law, particularly Article 84 of the Compilation of Islamic Law, a husband is not obligated to provide maintenance to a wife who is in a state of nusyuz. The study emphasizes that even though Islam allows certain actions by the husband in dealing with nusyuz, such actions must be guided by justice, wisdom, and ethical responsibility. Misapplication of these principles could lead to domestic violence, which contradicts Islamic values. A correct understanding of nusyuz and proper legal response are essential to ensure justice and maintain a peaceful, compassionate family life.
