Harmonization of Criminal Law Policy and Public Order Policy in Addressing Motorcycle Gangs Involving Children in Medan City

Abstract


This study examines the relationship between criminal law policy, juvenile criminal justice, and public order policy in addressing motorcycle gangs involving children in Medan City. It also identifies normative issues and proposes a proportionate policy synchronization model. The study employs normative legal research using statutory, conceptual, and case approaches. Primary legal materials comprise relevant legislation and court decisions, while secondary materials include scholarly articles, academic works, and legal literature. News reports are used only as contextual supporting materials and not as conclusive evidence of individual guilt or criminal trends. The materials are analysed qualitatively and prescriptively through statutory interpretation and an assessment of the relationships between legal provisions. The analysis indicates that policy synchronization should include clarity of legal authority, division of responsibilities between law enforcement agencies and local government, diversion in accordance with statutory requirements, victim protection, and continuity of rehabilitation and prevention. Effectiveness should not be measured solely by the number of operations or arrests, but also by procedural compliance, fulfilment of children's rights, victim protection, and follow-up rehabilitation.
